Terms of Service
ground is a small app for daily contemplative practice — a few minutes with a prompt. Use it however helps. Don't try to break it, copy it, or resell it. We make no guarantees, and ground is not a substitute for therapy, medical care, or a spiritual teacher. The rest below covers the details.
The agreement
By installing or using ground, you agree to these terms. If you don't agree, please don't use the app. These terms are between you and Clay Studio LLC; they are not an agreement with Apple.
Who runs ground
ground is made by Clay Studio LLC, a small studio based in Austin, Texas. For questions about these terms, write to legal@claystudio.app.
Your license to use ground
We grant you a limited, personal, non-exclusive, non-transferable license to install and use ground on any device you own or control that supports it, subject to the App Store's rules. This license does not let you:
- Copy, redistribute, sublicense, or resell the app
- Modify, reverse-engineer, decompile, or attempt to extract its source code
- Use ground or its content — including the prompt library, pillar and category structure, or branding — in any commercial product of your own
- Remove or alter ground's copyright or attribution notices
All rights not expressly granted to you are reserved by Clay Studio LLC.
Subscriptions and payments
ground offers three plans, with current pricing shown in the app and on the App Store:
- A monthly subscription, with a 7-day free trial for new subscribers
- An annual subscription, with a 7-day free trial for new subscribers
- A lifetime purchase, a one-time payment with no auto-renewal
When you subscribe or purchase through the App Store:
- Apple processes the entire transaction; we never see your payment details
- Monthly and annual subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends
- Your free trial converts into a paid subscription unless you cancel at least 24 hours before the trial ends
- If you start a paid subscription before the trial ends, any unused portion of the trial is forfeited
- Apple may charge your payment method within 24 hours of the renewal date
- The lifetime plan is a single payment that does not auto-renew
To manage or cancel a subscription, open Settings → [Your Name] → Subscriptions on your iPhone, or visit apps.apple.com/account/subscriptions.
We may change pricing for new subscriptions in the future. Existing subscriptions continue at their original price until they're canceled or terminated.
Refunds
All refund requests for App Store purchases are handled by Apple, not by Clay Studio. We don't have the ability to issue refunds directly. To request a refund, visit reportaproblem.apple.com.
Your content
Anything you write or save inside ground — your favorites, notes, and reflections — belongs to you. Clay Studio claims no ownership of your content. As described in our Privacy Policy, your saved content is stored on your device and is not transmitted to us.
Our content
The ground app — its design, code, prompt library, organization into pillars and categories, and branding — is the intellectual property of Clay Studio LLC and protected by copyright. You're free to use all of it inside the app for personal practice. You may not republish the prompt library, recreate the app, or use ground's content in a commercial product.
What ground is not
ground is a small daily practice designed to encourage a few minutes of attention to your mind, soul, and body. It is not, and is not intended to be, a substitute for:
- Therapy or psychotherapy
- Medical, psychological, or psychiatric advice
- Treatment for grief, trauma, depression, anxiety, substance use, or any other condition
- Crisis intervention or emergency support
- A spiritual teacher, religious authority, or community of practice
ground draws on contemplative traditions — Zen, Stoicism, present-moment awareness — but it is a tool, not a teacher. If you are experiencing significant emotional distress, mental health symptoms, or any kind of crisis, please contact a licensed professional or a crisis service. ground is a small thing. It is not built to handle situations that require trained, in-person support.
In the United States, the 988 Suicide & Crisis Lifeline is available 24/7 by call or text at 988. SAMHSA's National Helpline offers free, confidential mental health and substance-use referrals 24/7 at 1-800-662-HELP (4357).
No warranties
ground is provided "as is" and "as available," without warranties of any kind, whether express or implied. We try hard to make it work well, but we don't promise it will be uninterrupted, error-free, secure, or suitable for any particular outcome. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, Clay Studio LLC and its team will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of ground — including emotional, psychological, spiritual, financial, or reputational outcomes — even if we've been advised of the possibility of such damages.
In any case, our total cumulative liability for any claim is limited to the amount you have paid us for ground in the twelve months before the claim, or fifty US dollars, whichever is greater.
Apple's role
ground is distributed through the Apple App Store. Apple is not a party to these terms; your relationship with Apple is governed by Apple's own terms. The following points apply specifically to your use of ground on Apple platforms:
- These terms are between you and Clay Studio LLC only — not Apple. Clay Studio is solely responsible for ground and its content.
- Apple has no obligation to provide maintenance or support for ground.
- In the event of any failure of ground to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to ground.
- Clay Studio, not Apple, is responsible for addressing any claims relating to ground, including product liability claims, claims that ground fails to conform to legal requirements, and consumer protection claims.
- Clay Studio, not Apple, is responsible for the investigation, defense, and resolution of any third-party claim that ground infringes intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance, Apple will have the right to enforce these terms against you as a third-party beneficiary.
Changes to ground
We may update the app, change or remove features, or discontinue ground entirely. We'll try to communicate substantial changes through the app or on this page.
Changes to these terms
If we update these terms, we'll update the "Last updated" date at the top of this page. Substantial changes will also be noted in the app before they take effect. Continuing to use ground after a change means you accept the updated terms.
Ending your use
You can stop using ground and uninstall it at any time. Uninstalling removes the app and any data stored locally on your device. We may suspend or terminate access for anyone who materially violates these terms.
Governing law
These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles. Any disputes that aren't resolved informally will be brought in the state or federal courts located in Travis County, Texas, and you and Clay Studio LLC each consent to the jurisdiction of those courts.
